Welcome to Klingspor Online Store. The terms "we", "us" and "our" refer to Klingspor Abrasives South Africa (Pty) Ltd. We operate this store and website to provide you with a curated shopping experience (the "Services"), powered by Shopify.

Please read these Terms of Service carefully. By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.

These Terms govern your use of this website. Purchases are also governed by our Terms and Conditions of Sale, Shipping Policy and Returns & Refunds Policy. If these documents conflict on an online order, the checkout total and the Returns & Refunds Policy prevail. Nothing in them limits rights you have under applicable consumer protection law.

SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm you are of legal age in your jurisdiction. You are solely responsible for maintaining the security of your account credentials and all account activity. You may not transfer or assign your account to any other person.

SECTION 2 – OUR PRODUCTS
We have made every effort to accurately represent our products. Colours or appearance may differ from what appears on your screen. All product descriptions are subject to change at our discretion. We reserve the right to discontinue any product or limit quantities at any time.

Due to the nature of manufacturing processes, reasonable variations in quantity, size, colour and appearance may occur. Slight imperfections in colour and appearance are acceptable and do not constitute defects.

SECTION 3 – ORDERS
When you place an order, you are making an offer to purchase. An order is accepted when we send you an order confirmation after payment is received. If we cannot accept your order, we will tell you and refund any payment received.

All purchases are subject to our Refund Policy.

SECTION 4 – PRICES AND BILLING
All online store prices are in South African rand and include VAT. Delivery charges, where they apply, are shown separately at checkout before payment.

The amount you pay is the total shown at checkout when you place your order. We will not increase the price of a confirmed order. Price changes apply to future orders only.

If we find a pricing or product information error affecting your order, we will contact you and explain your options before proceeding. We will not charge an additional amount without your express agreement, and if the order is cancelled we will refund any payment received for it.

You agree to provide accurate and complete payment information.

SECTION 5 – SHIPPING AND DELIVERY
We deliver within South Africa only. Delivery times are estimates and are explained in our Shipping Policy. If an unexpected delay affects your order, we will contact you with an updated estimate and your options. Risk passes to you on delivery to your address or on collection from our premises.

SECTION 6 – INTELLECTUAL PROPERTY
All content on the Services, including trademarks, text, images, product designs and logos, are the property of Klingspor AG or Klingspor Abrasives South Africa (Pty) Ltd and are protected by applicable intellectual property laws. You may not reproduce, distribute or use any content without prior written consent. The sale of goods does not grant any implied licence over Klingspor's intellectual property.

SECTION 7 – OPTIONAL TOOLS
Access to third-party tools is provided "as is" without warranties. We have no liability for your use of optional third-party tools.

The Services may contain links to third-party websites. We are not responsible for their content, policies or practices.

SECTION 9 – RELATIONSHIP WITH SHOPIFY
Klingspor Online Store is powered by Shopify. All sales are made directly with Klingspor Abrasives South Africa (Pty) Ltd. Shopify is not responsible for any aspect of sales between you and us. You expressly release Shopify and its affiliates from all claims arising from your transactions with us.

SECTION 10 – PRIVACY POLICY
All personal information is subject to our Privacy Policy. By using the Services you acknowledge you have read and accepted it.

SECTION 11 – RETURNS AND REFUNDS
Returns and refunds are governed by our Returns & Refunds Policy, including the return periods, the circumstances in which a restocking fee applies and the amount of that fee.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS
We reserve the right to correct any errors, inaccuracies or omissions and to cancel orders where information is inaccurate, without prior notice.

SECTION 13 – PROHIBITED USES
You may only use the Services for lawful purposes. You may not use the Services for unlawful activity, to infringe intellectual property rights, to transmit harmful code, to scrape or extract data, or to interfere with the security or operation of the Services.

SECTION 14 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, Klingspor Abrasives South Africa (Pty) Ltd shall not be liable for any indirect, incidental, consequential or special damages arising from your use of the Services or products purchased through the Services. Any action for breach must be commenced within 1 (one) year of the cause of action arising.

SECTION 15 – INDEMNIFICATION
You agree to indemnify and hold harmless Klingspor Abrasives South Africa (Pty) Ltd, Shopify, and their respective affiliates, officers, directors and employees from any claims, losses or damages arising from your breach of these Terms, violation of any law, or use of the Services.

SECTION 16 – BREACH
In the event of breach, including failure by an approved credit-account customer to pay within 30 days of statement date, we reserve the right to cancel the agreement, suspend supply of goods and recover all costs including legal fees on the attorney-client scale. Interest on overdue accounts will accrue at the rate prescribed under the Prescribed Rate of Interest Act 55 of 1975.

SECTION 17 – GOVERNING LAW
These Terms are governed by the laws of the Republic of South Africa. The parties consent to the jurisdiction of the Magistrate's Court for any disputes arising under these Terms.

SECTION 18 – CHANGES TO TERMS
We reserve the right to update these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
